Applicability:
This process is for items held in secure storage as Found-Property / Safekeeping / Evidence related to a Law Enforcement incident. This does not apply to general Jail Inmate property. For information on Jail Inmate property, see the Jail section of the website or contact the Jail.
Bureau of Identification:
The Bureau of Identification (B of I) maintains secure custody of all Property / Evidence held by the Sheriff’s Office. Persons requesting return of property / evidence should make an appointment with B of I. Parties can call (608) 757-8000 and request to speak to a B of I member to make an appointment. Walk-in requests may be turned away due to staffing, and may otherwise be subject to an extended wait time.
Guidelines:
Property / Evidence returns must adhere to legal and policy standards. In many cases Property / Evidence cannot be released without express orders and official documentation from the court system. Often the timeframe which evidence must be held during investigation and following court processes is lengthy.
General Process / Requirements:
- Make an appointment
- Call the Rock County Sheriff’s Office main phone line (608) 757-8000
- Ask to speak to a B of I member (Monday – Friday 8am-3pm)
- Describe the property / evidence requested for return
- If possible, provide the related RCSO / Court case number
- Provide full Name / Date-of-Birth / Phone number of person requesting property / evidence return
- If the items are requested for release to a 3rd party on behalf of the owner, proof of the arrangement must be established (ie notarized letter)
- On the date of appointment / pickup
- Bring valid photo ID (ie State ID, Driver’s License, passport)
- Bring any documentation to prove ownership (ie vehicle title, bill of sale)
- Bring any legal documentation to confirm the item(s) is eligible for release
Firearm Returns:
- Firearms will only be released by appointment
- A required background check must be completed on all person(s) requesting firearm return, to verify eligibility to possess a firearm
- Parties requesting firearm return must complete a Firearm Release form (provided by B of I), and complete the included questionnaire regarding eligibility to possess a firearm
- Firearms will only be released to the rightful owner
- In many cases, a petition for return of a firearm must first be completed through the court system
- Proof of ownership for firearm(s) is required for all firearm returns (ie bill of sale)
- Ammunition will not be returned on the same day as a firearm(s). A separate second appointment on a different day may be made if desired, to receive ammunition
