Check to see if the citation is a municipal matter. If this is the case, the District Attorney's Office will play no role in prosecution of the citation. Instead, the City Attorney's Office or another legal office would be the prosecutor for the City, Town or Village in the event you contest (dispute) the ticket, and you will need to contact that office to proceed.
For non-municipal matters, the citation is not part of the official court record until the Clerk of Court receives and enters the same from the law enforcement agency. In most cases, this will take place within one to two weeks of the date your citation was issued.
One way to determine if the District Attorney's Office is the prosecuting agency is by looking up the citation on Wisconsin Circuit Court Access (CCAP). When you have found the matter and are on the view case details page, the Prosecuting Agency will be listed In the charges section.
If the Prosecuting Agency is the District Attorney's Office, please note that the District Attorney's Office does not see civil, non-municipal citations or police report(s) prior to the initial appearance for most citations. Therefore, we are unable to discuss your case (in person, in writing or by phone) prior to the court date on your citation.
